Your personal moral compass is of no interest in here, sorry to break it to you. Laws are put in place so personal moral compasses have nothing to do with someone winning or losing a case. As he is protected by fair use very obviously, he would have won in a fair trial.
You have grandiose ideas about morally right and wrong but honestly nobody in the law system would care about them. Your morality is pretty skewed anyway if you think big companies trampling over little guys just because they can is perfectly okay. In fact I’m glad we don’t use your moral compass in the system.

I don’t see how nsfw or any other artist give any harm to blizzard . It is almost like free advertisement of blizzard products .
Same is with cosplaying etc .

Cases take time to resolve. Costs can ramp up too. Its not only the cost of your legal team - it’s court fees, expert or multiple experts that may be required to write reports, disbursements, possibly counsel fees. Majority of cases nowadays settle before going to trial, but reaching that settlement will also take time. And win is not guaranteed. Loosing side pays twice - own costs and costs of the other side (subject to legal insurance, discretion of the court or form of settlement offer). Sometimes the possible damages awarded are not worth the effort and stress.

I don’t get it either why are they doing this I mean they are trying to shut down xxx content but that’s impossible because there is so much of wow smut on the internet that people probably regularly watch.Its like trying to shut down all of the private servers for wow and there are thousands it’s impossible so the problem with Rex was he was too mainstream wow smut creator he didn’t make an effort to hide it.For another example it would be like if a drug dealer yells out in the Streets of NY Hey people I sell drugs come and get me cops.There is also a thing called Rule34 and I wish them all the luck in the world shutting that xxx website down :thinking:.

Also all of this reminds me of Tumblr fiasco all of NSFW content got removed and some people say that 80% of people used it for it only which is a scary thought tbhshrugs.

If Blizzard have put up with his content for 10 years only to issue a C&D now, then something must have changed.

1: He crossed a line with his content that Blizzard felt was too far.
2: Enough people complained to Blizzard about his content, for them to take it seriously.
3: Blizzard felt it necessary for a different reason, that they alone know.

I’m not familiar with his content, so I have no idea if there were warnings about the nature of the content.

It’s everything on the edge, really. If I were him, I would’ve done the same in this case. I’m a content creator myself and, I try to see it with both blizzard’s eyes and his ones:

On one hand, BLIZZ creates things that get twisted and made parody by someone else. That alone upsets many people, but it’s something personal, so let’s remember it but put it aside too.

On the other hand, there’s this content creator who uses others’ work to make his modified version, which happens every day if you think about it, in many other contexts too.

But, the problem here is patreon which itself works on the “edge” of law, requiring donations for content which, honestly, are more like a subscription rather than a true donation, so there’s that. Perfectly legal of course. But he RECEIVES money for that work, even if in the form of “donations”. So there’s this too.

Plus, a legal precedent in his favor.

So you can see that the odds ARE in his favor here. But, as he says more or less, it’s not worth it. There are reasons for blizzard to be upset with him, and honestly if someone did the same with my creations, I won’t lie and tell you I wouldn’t be angry at him, even though it’s legal.

So, I respect his decision to comply and see blizzard motivations rather than “attacking back”. It’s sportsmanlike and kind on his part, and I’m sure he, as a content creator, can go forward and keep doing his things even without those assets.

In the end I think both have reason here, though I don’t think in this case fighting would achieve anything good. While bitter, it’s a good end to the case, probably better than a lawsuit.

The judge goes with the law, his personal feelies on an artist making slightly unwholesome pic’s based on good ol’ clean family fun franchise doesn’t enter the equation.

I kind of agree because I believe that content didn’t hurt or affect anyone :wink: so I believe they just wanted to show that they have power,but who knows actually I don’t want to devolge into this any further out of fear I don’t get a 10th Silence from them.I think I should get an achievement for being the most silenced person on the forum due to some people either being not accepting of the truth or being offended by too insignificant things.
