Technically speaking, things should not have a “purpose” in such a fixed sense: I can sell a bottle as something else than a drinking item and it is completely fine. For example, as a piece of decor.
Second, houses can remain uninhabited for a long period of time, just as anything else can remain unused for a period of time. Owner’s rights and all. Most people surely have things they don’t use for a while, should they immediately lose their rights to something the moment they don’t actively use it? It doesn’t make a lot of sense.
But in the end, it will just be an agree to disagree on this bit, I suspect.
His work should be understood in its proper context, the post-Soviet Tolkien fandom, which was a giant subculture of its own. It still exists, though diminished, a little enclave of the elder days, before darkness grew unchecked.
And he did quickly move on to his own original worlds, his Tolkien fanfiction was basically a stepping stone that let him grow as a writer.
I’d object to profiting from unauthorized Tolkien sequels now, but in the nineties the realities were different.
And even now, I think it’s awesome that there are three different unauthorized Beren and Luthien musicals still performed in Russia. One with horses.

I know of several writers who did just that (minus the monetising your fanfic, that’s very much frowned upon and actively combated in the modern fic writer community, just had an issue with people on tiktok getting into book binding and selling other people’s fics that way… the only thing people accept is people taking writing commissions and ko-fi donations but none of that is allowed to be mentioned on the current biggest fic archive)
Honestly a lot of the fanfiction I’ve read is pretty much already original, if perhaps using character names or their archetypes for their stories. Some fanfiction get very liberal with the setting they’re given, especially when it’s in an AU setting.
I saw one Stucky fanfic get edited with an announcement and then deleted because the author apparently got a book deal to rewrite the fanfic to be more original and have it released as a book or something. And honestly, the setting itself was already AU enough that it could’ve been any random romance story you see on the TV, not something connected to the MCU.
I just think stifling people’s creativity by admonishing them for using your characters to write their own stories is crap.
I’d take the approach of; “I’m happy you have found your creativity using my world but please don’t expect me to read it, the almighty need to correct you when you mischaracterise is hella strong. But do carry on with my blessing”
Time to stop being a hater and start being a lover. Imagine being a MCU consoomer. Your favourite cameo pops up for 5 seconds in your 2 hour long movie of cameos and your entire week is immediately made, the clouds part, and whatnot else.

Also seriously, “The Fellowship of the King”? Even by fanfic standards this is unimaginative. It’s like calling a Star Wars fanfic “The Jedi Strike Back”.
Edit: it’s available online for free because it was evidence in the court case. As expected, the writing is absolutely terrible.
