Refund policy for "flagged" account

I ask for a refund for a subscription. In the ticket I received an answer that is basically saying : “Unfortunately you need an irreproachable account to received this refund which is not the case”.
Refund policy indicates " We may withdraw refund eligibility for abuse of this policy, such as repeated refunds for the same product. The same goes for violations of the In-Game Code of Conduct or the End User License Agreement which let think that a refund might still be possible even if the account is not irreproachable but that they can revocate this right (and it seems in my case this right was revocated).

Now the context :

  • I get ban 1 month from the recent pvp ban wave (after 11 years of playing, with 0 sanction and 0 warning).
  • I contest the ban few hours after it occurs because I was pretty sure not deserving a such severe suspension
  • The ticket waiting time was saying 16 days and growing each hours.
  • Even if they would agree I don’t deserve a such ban they will not be able to process my ticket in time before Wotlk launch (based on the ticket time growing). So my only possibility to play during the Wotlk launch was to use a second account
  • I subscribed a second account and start level-up a DK (only have a DK a anyway on my main account)
  • Less than 24 hours after the subscription of the second account my suspension was reduced to 8 days (automatically as a blue post said it was because it was the first suspension)
  • The message was saying “we don’t want to discuss that anymore” → I close the ticket even if I knew no human had read it, there were to many bans and they can’t do case by case (my ticket won’t be processed in time anyway).
  • Less than 24 hours after the subscription with no benefits taken from the second account (no gold sent or object sent) I asked for a refund for the second account.

Is it fair to not be able to received a refund in that case ?

When we get ban we already have our current subscription running while we can’t use it, so we already loose money for nothing.
Now i have 2 useless subscription running, one which could be fair because of the suspension and an other one because I subscribe a second account as Blizzard was telling me that my ticket will take for ever to be processed.

Also suspension is already a punishment. Should really blizzard change their refund policy depending on the history suspension of the player ?
Should the context be taken into account ? Same for the nature of the suspension ?

Not asking for any refund in 11+ years (while beeing clean) and not beeing able to use this service the first day you need it because you are not clean anymore (for a rule that seems a lot subjective compared to botting or RMT) feels akward.

Do blizzard change some other policies based on the history suspension of the account ? Should they do some things like not letting people who were suspended in the past connect to high populated realm so they do not contribute to queue ? Or maybe they should also reduce the loot probability for these guys ?

I am here to get other people opinions as I find this behavior strange and i wanted to know if I am the only one to think that.

Yes, per their refund terms. As you’ve been officially punished by 8 days after review.

For your 2nd account: If it’s considered “clean” you still won’t be able to receive a refund due the fact you’ve already started to use the gametime in question. (Levelling the DK)

A penalised account will not be able to sign up on beta and other promotions that require “in good standing” status. This will eventually lapse depending on penalty and history. You’ll otherwise have no other handicaps like what you mentioned (the queue/lower drop chances).

The refund policy says they “may” cancel this right. I don’t know why it should be automatic.

For the 2nd account I received the answer that it’s because of the suspension that I can’t get the refund. Both accounts are linked to the same battle.net account so it might be why.

I agree they autorise themself to do that in their refund policy but I don’t think it’s 100% fair that your account is white or black.

There are two ways at looking at it, one is you forfeit the right to a refund by getting banned, the other is you forfeit it because you have already used some of it.

It’s like you bought a cake, took a bite then you dropped it on the floor by accident and want your money back or the ban is like you threw it on the floor and want your money back.
