The legality of herb and mine farming with a two-person mount

These days, during herb and mine farming in various maps of World of Warcraft: The War Within, I often see two-person mounts — such as Druid or Dragonflight mounts — where two players ride together; one dismounts to gather the herb, then mounts again.

these players have purchased two expansions and two game times on their Battle.net account, running both as WoW1 and WoW2 in separate windows. They group the two characters together and farm simultaneously to effectively double the amount of herbs and ores collected.

Is this action legal? Especially considering the upcoming Midnight expansion — if no macros or multiboxing software are used, and the player manually controls both characters, is there any risk of getting banned?

Yes it’s within the TOS. As long as they are doing the actions on that characters screen. There is no risk of being banned if you control the characters manually.
