Sorry, but you’re not.
Not even close.
Downtimes are expected, and covered in the TOS.
What is defined as downtime? Becuause I didnt read in ToS that game is offline whole resetday. If they shut down game for 1 week would it still be OK? Where is the line mate?
Whole day? It’s literally not even 90 minutes.
Acknowledgments. You acknowledge that:
Blizzard is not liable in any way for the loss of data or damage to the Beta Test System, interruptions of service, software or hardware failures, or loss of data or disruption of service;
In the ToS, Game Features.
The line is wherever we players choose to draw it.
At then end of the day if we decide that Blizzard isn’t giving us the level of service we’d expect for our sub we have the option of cancelling that sub.
it’s been gone for hours tho not 90 mins
Err… I’m not?
It’s only a few hours max if/when it happens, and always preventing unforeseen mess ups is just not a realistic expectation.
I mean, both me and my friends were playing just fine up until an hour ago and people only starting posting “Is the server down” about 90 mins, so… not sure
Sorry, but nope.
You’re only covered by the Terms of Service. Under no condition is blizzard required to refund you for you not “liking the availability” with the only exception of refunding an online purchase without reason in the first 14 days.
That’s pretty much all you get.
Anything else is simply generosity from Blizzard’s side.
I tried getting in first time over 3 hours ago like what are you on about
The last time I got any compensation was after an extended period of instability. Many many years ago.
Downtime is an unfortunate thing that happens with all services from time to time.
I’m never going to say No to compensation, but I think it’s unlikely we are going to get anything for such a short period.
Best of luck tho
ToS cannot override existing consumer legislation, though the big tech companies act like they do.
But effectively you’re correct, in that there’s no legal requirement for an online service to provide 24/7/365 service.
OP, you could take a small claims court case to compensate you, but unless you can demonstrate you’re out of pocket in some way (for example you took annual leave today specifically to play WoW) then you probably won’t win.
Imagine having a billion dollar company and your game is inaccessible for hours on multiple days/month due to server issues.
I assume there are people hired to do this job exactly and take care of the servers and have them stable …If I’d do the same quality of job and make errors this frequently I would be fired
Must be nice having a nice paying job with 0 responsibility and accountability …and the same applies to the company.
Blizz fired ~900 member of the player support staff a few years ago in a year when they had record profit… this alone should tell us everything we need to know regarding how much they care.
The support now is terrible, it takes 3-4-5 days to get and answer which is usually a macro response that doesnt even address your issue.
They implemented an automated report system for chat which doesnt account for anything it simply punishes people based on the amount of reports they get. This was proven by multiple famous twitch streamers when they asked their raid to report them and they got instantly banned for simply saying “hello” and get 20-30 report on it.
You also cant argue your punishments made by these robot system even if they are false positives and you get punished for no valid reason.
Retail does not get meaningful hotfixes and balancing even after weeks into a new season while they focus most efforts on classic/season of discovery so if you are mainly/only play retail you feel like you are a second class citizen in the game…
They cut full patch content cycle in the end of shadowlands and they got so comfortable with it they did it again now in Dragonflight …enjoy your recycled raids with “fated” as content instead of an actual last raid patch with a real last season…
They give you less content while you pay the same sub fee and you pay increased box price for the game.
And now we can see their play …now that you got used to 1 less patch cycle costing you more money we will get 3 expansions in rapid succession in 1 and a half year release times so they can cash in on the increased box prices fasted while they proved less content by cutting out a whole content patch from each expansion.
They robbing us blind and they dont even care to have stable servers
This is from the EULA (there is no ToS anymore since a few years back).
However, you’re quoting a part regarding beta testing.
(You’re quoting 3 e, 3 is “Beta Testing Pre-Release Versions of Games”)
Sure, playing retail sometimes feels like beta testing, but it’s really not.
Pretty much this
You’re right, but the EULA Repeats it further down:
Limitations of Liability. To the fullest extent allowed by applicable law, Blizzard, its parent, subsidiaries, Licensors and affiliates shall not be liable for any loss or damage arising out of your use of, or inability to access or use, the Platform or Account(s). Blizzard’s liability shall never exceed the total fees paid by you to Blizzard during the six (6) months prior to your making a claim against Blizzard, unless applicable law explicitly disallows this limitation, in which case Blizzard’s liability shall be limited to the fullest extent permitted by applicable law.
Don’t get me wrong, like anyone else I loath not being able to play or use the service I am paying for, and I expect better from this company, but it is what it is.
As compensation I demand for Pelagos to get his ar$e kicked by Gammon in the middle of Valdrakken.
please never post again
Please dont act like planned restarts and downtimes are the same as frequent server issues. No one is complaining when there is a server restart or the servers are down due to planned maintenance…
Many other companies for example Riot games “compenasate” players for issues like this. They might not give you much but a capsule with some loot or something but at least they show they are sorry and they care. When did Blizzard do anything like that?
They could easily send out lets say 300 tender currency which isnt really that much but most people would greatly appreciate it …and not only because many of us is wasting time - literally hours now - not being able to log in and play when the servers suppose to be up …but because it would be a nice gesture that acknowledges their error and shows us they care about our time we are wasting on this game.
But any long time player knows Blizz dont care, the times when this game was made by gamers to gamers is long gone, now its a company milking the playerbase for money as much as they can and they take 0 responsibility for any issues they cause directly or indirectly.
