Puny, I think the OP is a SJW and wants to prove Blizzard wrong, when their legal team wrote the terms and conditions of use with an exact wording and made it so nothing will fall through the cracks.

Technically, there would exist an obligation to sacrifice your child. Depending on the applicable law and jurisdiction, the clause is either unenforceable (e.g. because it violates the principle of reasonableness and fairness) or void (e.g. because it is unlawful and/or immoral). A void clause is deemed to have never existed.
The key question is what “service” you are paying for. Blizzard does not guarantee 100% uptime on their servers, and a certain amount of downtime is expected. The court will have to determine whether the downtime you experienced is so excessive that Blizzard is deemed to not have provided their services in accordance with what they promised and what you might reasonably expect from them. The terms of service will probably also make clear that you are not entitled to refunds or other compensation in case of downtime.
You should at least READ them before signing them, after all they should be in plain English, remember the episode of south park and the iPad agreement? That’s an extreme example but should be read as a warning.
