Private servers?

I bought my Vanilla client. I still have the DvD and box. I payed for it and I own it. If I break ToS and connect to a private server its a civil matter and not a legal matter.

If anyone try to take my software away from me they are stealing from me.

Even if it is illegal in some countries doesnt make it immoral. There are all kind of immoral laws in different countries. Not being allowed to use software you bought and payed for is immoral.

I would even claim its stealing not to allow people to use software they bought and payed for. Not by law, but by morality.

Your original WoW Vanilla discs - the client - won’t work by themselves on a Private server - you’d need to download an update - at that point you are actively engaging in a copyright infringement

It’s no different than watching a film on a pirate download / streaming channel

You have not paid the copyright holder the fee they are owed

Some folk are cool with that - and it’s unlikely you’ll ever get a bill - but it’s still dishonest

Dishonest is to sell a product, and when the customer is back at home with his product + purchase invoice, pretend the customer does not own the product.

Wrong, can count on one hand the number of disconnects I experienced in 8 months on ND. There was about 2-3 days of downtime when they got targeted by a script kiddie, but so did Classic and the launch of Classic was just as bad as in 2004.

And right now we are playing Classic with 400ms of ARTIFICIAL LAG, this is infinitely worse than any private server.

Basically, if you could combine ND with accurate values then you would have the perfect server. Blizzard is failing at their own game

You purchased a client - not the game - it’s not a Xbox or play station game - it’s an online multiplayer environment which constant updates and maintenance - you paid to play a specific expansion of the game subject to a subscription from Blizzard

I apologise if the concept is flying over your head - but that’s simply the reality here

Blizzard have not - at this time - agreed to license any third party to operate their own servers - as soon as you access one you are committing an act of copyright theft

Emulators are allowed in Europe and even in USA. Did you hear about Nintendo or Playstation emulators ?
They are legal, no licenses needed to develop an emulator. This is the reason private servers source code can and is hosted in github (a Microsoft company).

You can’t really level that criticism - they are operating their servers as they see fit - which to some does not compare favourably with pirate servers

it is not legal to operate a pirate server hosting and version of Blizzard’s world of Warcraft - that’s why they have been closed down

You’ll see the odd hobby server spring up here and there - and Blizz May even tolerate them until they bring action in batches

Copyright law in Europe is even more stringent than the US - your argument is based on a poor fact find

They have not been closed down (at least no in Europe) by Blizzard. Blizzard only sent cease & desist letters , that are usually ignored.
Nost owners decided to shutdown the server as an act of protest to force Blizzard open vanilla servers. After a month of large scale protests (and almost 300k petitions in change org), Blizzard invited the Nosts team to the Blizzard HQ to present the case for Vanilla.

A company has to take pre-commencement action prior to any formal action through the courts

An individual seeking compensation for breach of contract or personal injury has to do the same

The pirate server operators understood full well that attempting to defend their copyright breaches would be financially ruinous and futile- they would never win

And that’s the usual outcome with such commercial wrangling

Github does not host pirate servers - it’s hosts the source code so that third party developers can developer - in the case of WoW - AddOns which comply with the Eula and terms if service

And that is quite normal for any platform

You may remember the issues between Apple and Flash - who refused to comply with Apple’s rules to use its source and were blocked from running applications on its operating system - despite much speculation the IT industry has to shift - bend to Apple’s will

So with the greatest of respect - you have no argument here - copyright theft is copyright theft

Sorry but here you have no clue what are you saying ( you are mixing different things up), you can download Nost source code from github (not blizzard code, a private server emulator code), and run a vanilla private server in your computer in a couple of hours. Im not going to put here the link, but is the first result in a google search.

And you’d be breaching the licensing rules of both Github and Blizzard

It’s their to allow developers to add value not to steal the software and sell their own version

Copyright theft is not okay - it is taking somebody else’s time and effort and illegally profiting from it

It makes no difference how well you do it or how many people wish to access the service - it is still criminal behaviour

Get a license- pay to operate - that’s a different proposition

Did you realize that you are denying the reality ? The source code of a lot of private servers are hosted in github, for example Nost source code in github is 3 years old !!! Maybe github did not realize the source code was there for 3 years ?

In the meantime, stop thinking that a server where:
World chat literary is a spammed channel.
Zones have min 50~100 players even not in peak time
There is min 50 of LVL 1, 2 & so on.

That’s not a good server that’s a huge 2019 to crazy server. You all should hat known that those who rolled horde only wanted one thing. (majority) Pvp.

Funny is all this mega bega servers laughed at us one the ”dead” server cause we asked for more ”when it was low” and before PVP.

No, they are failing by pandering to pirates.

Put the servers back on Vanilla values and everything will start working as intended.

10-15k PvP mega servers is NOT Vanilla WoW.

Reverse engineering is a complex topic and law differs by region. Similarly software rights. In USA you can’t “legally” make a Hackintosh not to mention sell those. In EU you can and all you need is an Mac OS licensed copy. Vendor may not support it but he can’t say in EU what you can or can’t do with your copy of a software.

Private servers would breach the law if they would distribute game clients so they officially don’t do that. But if you have the client then you can connect to that server and not the Blizzard one. It’s legal although not supported by the vendor in any way. Servers themselves can breach the law when they use Blizzard IP - like if you make money from it, or depending by country be just using copyrighted names, Blizzard assets etc. Some pservers were hit for making money directly from the IP, some that they were using exactly the same numbers as Blizzard did but many managed to just operate without problems by avoiding things they can’t do in given country.

As for the servers themselves - they are completely legal unless they use original code of Blizzard server infrastructure (which didn’t happened as of now). Basing on client communication protocol people re-implemented the server to make the client work. Similarly how ReactOS is reimplementing Windows to make a Windows compatible system work by fulfilling all the public APIs the system has.

They have docker images and if you like have 1.12 client you can build and launch a server and connect to it with 1.12 client. The client is needed to extract some assets needed for the whole thing to work. The “grey” stuff is - is those assets really Blizzard unique IP or not. Older WoW versions have it easier as less is shared over the client-server API while more latest expansion servers are more likely to breach the local laws as more assets is actually exchanged over the API (maybe even explicitly for this).

A server opened by someone not working for Blizzard, thus making it private. This is clearly against the Terms of Agreement and players who have been playing there should know that Blizzard have every right to ban their Battlenet account. I honestly don’t care about my account, so here’s what I have to say about the matter:

There are 2 sides to this.

The good: Without the private server Nostlarius, we wouldn’t be playing classic WoW on Blizzard servers now and that’s a fact. Nostalrius was in every way a better server and gave me a better classic experience than this.

The bad: A classic WoW version 2 would have been much better. In which I mean a completely different game but with the same foundation. This thing has been sucked dry already and that is because of private servers. Players who are trying this out for the first time (maybe since ever or since the official launch) are facing off in PvP against former private server players with full tier raid gear. And that’s only one of the problems.

Conclusion: The social aspect of the game is on par with whatever expansion is out on the achievement/mount grinder that they call World of Warcraft retail. People are screaming for content because for reasons stated above, they want classic servers to be over with ASAP.
And to the players who look to solo queue in BGs like they did back in the day? You’re in for a massive dissapointment. Get ready for Hpremades and Apremades dodging each other in other to farm pugs. This was how we did it on Nost and from what I’ve experienced, every horrible player behaviour from every private server on the web (including my own), has been transferred to Classic.
If blizzard had released these severs before Nostlarius, then this woud have been a completely different game and i’m part of that horrible crowd who destroyed non private server players first classic experience.
